Terms of Service 

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website: www.adpaf.org  (together or individually “Service”) operated by ADPAF. 

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. 

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound by them. 

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at info@adpaf.org so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service. 

By accessing materials on adpaf.org : 

  • You acknowledge that ADPAF owns and operates this site, and that it contains material for which ADPAF owns or has permission to use the copyright. 
  • You are permitted to download anything from this site for personal, non-commercial use only if all copyright and other proprietary notices are preserved. 
  • Without ADPAF’s prior written permission, you may not change, copy, reproduce, publish, upload, post, transmit, or distribute any material from this site, including any programming code and software, in any way. 
  • All access to the site originating with your identity and any password required for site access is strictly your responsibility. 
  • You do not acquire any ownership rights by downloading any of ADPAF material

You grant ADPAF a nonexclusive, royalty-free, unrestricted, worldwide license to use, copy, publish, distribute, adapt, transmit, or publicly display any such communications if you send an email to any ADPAF list server, online community, or other ADPAF site that allows such messages, or if you engage in any other form of communication through this service.

The materials on ADPAF.org and its subsidiary sites are given “as is,” with no express or implied warranties of any kind. ADPAF disclaims all warranties, express or implicit, to the fullest extent permitted by law, including but not limited to implied warranties of merchantability or fitness for a particular purpose. ADPAF makes no guarantee that the functions performed on this website will be uninterrupted or error-free, that defects will be corrected, or that this site, including list servers and online community software, or the servers that make them available, will be free of viruses or other harmful components. 

ADPAF may provide links and pointers to Internet sites maintained by others. ADPAF has no control or responsibility in any respect for any information, products or services on these third-party sites. 

ADPAF does not warrant or make any representations regarding the use of, or the results of, the materials on this site or in third-party sites in terms of correctness, accuracy, timeliness, reliability, or otherwise. ADPAF List Servers and Online Communities 

ADPAF does not control the messages, information, or files posted to ADPAF list servers or online communities. As a condition of use of these tools and ADPAF.org you may not: 

  • Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including, without limitation, any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, provincial, national, or international law. 
  • Without the consent of the owner or right holder, you may not post or transmit any information, software, or other material that is an invasion of privacy or publicity or that is protected by copyright, trademark, or other property rights. 
  • Post or send any virus-infected data, software, or other material. 
  • Post, transmit, or otherwise exploit commercial or promotional information, software, or other content. 

You understand that ADPAF has no obligation to monitor these tools, but reserves the right at all times to disclose any information as necessary to satisfy any legal, regulatory, or governmental requests, or to refuse to post or to remove any information or materials that, in whole or in part, ADPAF deems are objectionable, unrelated to its mission, or in violation of these terms and conditions. 

Limitation of Liability 

As a condition of use of the list servers or online communities, you agree that neither ADPAF, its affiliates, nor any subsidiaries shall be liable for any direct, indirect, incidental, special, or consequential damages caused by the use or posting of any material on the ADPAF site by ADPAF or any ADPAF user. 

Notification Regarding Alleged Copyright Infringement 

If you notice information on any ADPAF website, listserve, or online community that may constitute copyright infringement, you can report it to ADPAF so that it can investigate. Notification of claimed copyright infringement should be sent to:

Indemnification 

You are personally liable for your actions while using the ADPAF.org website. You agree to indemnify, defend, and hold the Association Of Drilling Professionals In Africa and any affiliated companies harmless from and against any and all liability and costs, including but not limited to reasonable attorney’s fees and settlement amounts, incurred by the Association Of Drilling Professionals In Africa and any affiliated companies in connection with any third-party claim or demand alleging losses, damages, injuries, expenses, harm, costs, and the like arising out of your actions. 

 

Termination 

ADPAF reserves the right to suspend or discontinue ADPAF.org or any of its services at any time. ADPAF may also suspend or terminate your access to ADPAF.org if you violate any of these terms of service. You will lose access to terminated services if the agreement is terminated.
